Maritime IntelX (“Maritime IntelX,” “we,” or “us”) is committed to protecting and respecting your privacy.
You should read this Privacy Policy together with the Maritime IntelX Terms of Use.
References to “you” or “your” are to the individual whose personal data we receive and/or access in connection with our business. References to “the service(s)” and “website(s)” are to the software products and websites provided by Maritime IntelX.
The purpose of this Privacy Policy is to explain how we use any personal data we collect from you or access about you in connection with our business. It also describes your rights to access or change your personal data.
Please note: In many cases, our customer (e.g., your employer) acts as the Data Controller for your personal data, and Maritime IntelX serves as a Data Processor. This means that we process your personal data according to the instructions of our customer.
1.0 Customer’s Obligations
For the purposes of this Privacy Policy:
- “Data Controller” has the meaning set out in the GDPR.
- “Data Processor” has the meaning set out in the GDPR.
- “Data Protection Regulator” means the applicable supervisory authority with jurisdiction over either party, and any successor body from time to time.
- “Data Subject” has the meaning set out in the GDPR.
- “Privacy Laws” means all applicable data protection and privacy legislation, regulations, and guidance governing the protection of personal information including, but not limited to, Regulation (EU) 2016/679 (the “General Data Protection Regulation” or “GDPR”).
- “Process,” “Processing,” or “Processed” have the meaning set out in the GDPR
Data Controller and Data Processor
- The parties acknowledge that our customer is the Data Controller and Maritime IntelX is the Data Processor of any personal data that the customer provides to us.
- Maritime IntelX will Process personal data in accordance with Section 2.0 of this Privacy Policy (and any applicable Data Processing Agreement or Addendum).
Customer’s Obligations as Data Controller
- The customer warrants that any personal data provided to Maritime IntelX has been obtained fairly, lawfully, and in all respects compliant with applicable Privacy Laws.
- The customer shall comply with all applicable obligations under Privacy Laws and shall fully indemnify and hold Maritime IntelX harmless from and against any and all losses, damages, claims, costs, and expenses (including reasonable legal expenses) suffered or incurred by Maritime IntelX as a result of or in connection with any breach by the customer of this Privacy Policy and/or the Privacy Laws.
2.0 Collection, Use, Protection, Storage, and Disclosure of Your Personal Data
2.1 How We Collect Your Data
When you visit our websites or use our services, we collect personal data in the following ways:
- Information you provide to us
- You (or your employer, our customer) may provide personal data when you:
- Create an account to use our website or services;
- Make an inquiry, provide feedback, file a complaint, or submit correspondence via post, email, or on our website;
- Fill in forms on the websites provided by Maritime IntelX (for instance, when registering for a service or requesting further information);
- Subscribe to our newsletter or mailing lists.

- Identity and contact data: Name, location, job title, phone/mobile number, instant messenger username, and email address;
- Financial data: If you purchase our services, you may provide payment details (billing addresses, credit/debit card information, and bank account details).
- You (or your employer, our customer) may provide personal data when you:

- We collect some information about you automatically when you visit our websites or use our services, such as your IP address and device type.
- We also collect information about how you navigate our websites and services (e.g., pages viewed, links clicked).

- Information we receive from third parties
- As a Data Processor, we may receive information about you from our customers (your employer) in the course of providing our services (e.g., your name, role, and email address to create an account).
- We may also receive information about you from third parties if you have indicated to them that you would like to hear from us (e.g., integration with your existing ERP software).
2.2 How We Use Your Data
We primarily use your personal data to operate our websites and services and to manage our relationship with you. This includes:
- Communicating with you
- Providing information you have requested (e.g., training or educational materials);
- Sending operational communications (e.g., changes to our websites and services, security updates, or help using our sites and services);
- Sending marketing communications (in accordance with your marketing preferences);
- Requesting feedback or asking you to participate in research.

- Assisting with the resolution of technical support issues or other issues relating to the websites or services, whether by email, in-app support, or otherwise.

2.3 How We Protect Your Data
- Maritime IntelX endeavors to follow recognized standards and best practices for security, availability, processing integrity, confidentiality, and privacy of our systems (e.g., SOC II or equivalent standards).
- We implement commercially reasonable technical and organizational measures against unauthorized or unlawful processing of personal data, and against accidental loss, destruction, or damage to personal data.
- However, the transmission of information over the internet is not entirely secure. Any data you transmit to our website and services is done at your own risk. If you suspect unauthorized access to your account, please notify us immediately.

2.4 Where Your Data Is Stored
- Personal data is primarily stored on servers hosted by our providers (e.g., Microsoft Azure), located within the European Economic Area (EEA).
- However, data we collect may be transferred or accessed outside the EEA. It may also be processed by staff operating outside the EEA who work for us or our suppliers in connection with providing our services.
- Whenever we transfer your personal data out of the EEA, we ensure a similar degree of protection by using one or more of the following safeguards:
- Transferring data only to countries deemed to provide an adequate level of protection by the European Commission;
- Using specific contracts approved by the European Commission, which give personal data the same protection as in Europe;
- Where applicable, relying on the EU-US Privacy Shield framework or a similar mechanism for transfers to the US.
2.5 When We Might Disclose Your Personal Data
In connection with the purposes described in this Privacy Policy (and on lawful grounds), we may share your personal information with:

- Sub-processors involved in delivering and supporting our services (e.g., hosting providers, data analytics, etc.), provided that they comply with applicable laws and our instructions regarding the processing of personal data.

- To enforce our Terms of Use;
- To protect the property, rights, or safety of Maritime IntelX, our users, or others;
- In order to prevent fraud or reduce credit risk.

- In connection with (or during negotiations of) any merger, sale of assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company.
2.6 Cookies

2.7 Data Retention
- We retain your personal data for as long as necessary to provide you with the services you have requested or for as long as we have a legitimate business purpose to do so (e.g., exercising legal rights).
- We operate a data retention policy to minimize the amount of data we hold and the duration for which we keep it. For instance, we maintain a suppression list of email addresses of individuals who no longer wish to be contacted by us—this is stored permanently to ensure we respect your opt-out.

Because our customers often act as the Data Controller, you may also need to contact them directly if you wish to exercise your rights in relation to data provided via our services.

3.2 How to Exercise Your Rights

- We may request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise other rights).
- As a Data Processor acting on behalf of our customer, we may have to notify them of your request and follow their instructions regarding your personal data.
- We will respond to all legitimate requests within one month, unless the request is particularly complex or you have made multiple requests. In this case, we will inform you if we need more time.
4.0 Changes to This Policy
Maritime IntelX reserves the right to modify this Privacy Policy at any time, though we will strive to provide advance notice where possible. We will post the updated Privacy Policy on our website. Any changes become effective when published on our website.
